Acceptance of Terms

By using ShinyDex.com, you confirm that you are at least 18 years old or have parental/guardian consent and that you agree to comply with these Terms and Conditions.

Description of Services

ShinyDex.com is a shiny Pokémon tracking website that allows users to log, track, and manage information related to shiny Pokémon. We provide tracking tools, social media login options, and other features to enhance your experience with shiny Pokémon collection.

User Accounts and Social Media Login

To use certain features, you may need to create an account using a social media login. By connecting a social media account, you authorize ShinyDex.com to access certain information from that account, including your social media ID and public profile details. You are responsible for keeping your account information confidential and for all activities under your account.

ShinyDex Pro Subscription

ShinyDex.com offers a premium membership, ShinyDex Pro, which provides access to exclusive features and additional functionality on the Site.

• Subscription Cost: ShinyDex Pro starts from £2.99 per month.
• Billing: Payments will be automatically charged on a recurring monthly basis through your chosen payment method.
• Cancellation: You may cancel your ShinyDex Pro subscription at any time through your account settings. Cancellations will apply to the next billing cycle and will not result in a refund for the current billing period.
• Revocation of Access: ShinyDex reserves the right to revoke access to ShinyDex Pro features at any time for any reason, including but not limited to violation of these Terms and Conditions or misuse of ShinyDex services. In cases where access is revoked, ShinyDex is not obligated to refund any paid subscription fees.
• Gifted Subscriptions: ShinyDex Pro subscriptions that are gifted to another user are non-refundable under any circumstances. Gifted subscriptions are transferred immediately upon purchase and cannot be revoked, exchanged, or reimbursed once redeemed. ShinyDex bears no responsibility for gifts sent to incorrect accounts.

Cosmetic Purchases

ShinyDex.com offers optional one-time purchases of digital cosmetic items ("Cosmetics"), sold individually or in bundles ("Packs") through the ShinyDex store. The following terms apply to every Cosmetic purchase, in addition to the general terms above.

• One-time purchase: Cosmetics are a single, one-off purchase and not a subscription. The price is shown before you confirm and is charged once, securely via Stripe.
• Immediate delivery & consent: Cosmetics are digital content delivered to your account immediately upon successful payment. By completing a purchase you expressly request immediate delivery and acknowledge that, as a result, you lose any right to cancel, return, or withdraw from the purchase.
• All sales are final: To the fullest extent permitted by applicable law, all Cosmetic purchases are final and non-refundable. By purchasing, you agree that you are not entitled to, and irrevocably waive, any refund, cancellation, exchange, credit, or reimbursement under any local, national, or international consumer-protection or distance-selling laws, save only for any rights that cannot lawfully be excluded.
• Discretionary refunds: Any refund or reversal is granted solely at ShinyDex's absolute discretion and on a one-off basis. It creates no right to, or expectation of, any future refund.
• Chargebacks: Initiating a chargeback or payment dispute for a validly completed purchase may result in suspension or termination of your account and forfeiture of all Cosmetics and other benefits.
• Licence, not ownership: A Cosmetic grants you a limited, personal, non-transferable licence to display the item on your ShinyDex profile. It is not a good, currency, or asset that you own and has no cash value. ShinyDex may modify, replace, or revoke Cosmetics - for example for breach of these Terms or misuse - without refund.
• Acceptance at checkout: You must confirm that you have read and accept these purchase terms before you can complete a Cosmetic purchase.

User-Generated Content and Media Uploads

Users may have the ability to upload image or video content to the Site. While we do not take responsibility for any such content uploaded by users, we reserve the right to remove any content that we deem offensive, inappropriate, or in violation of our guidelines or applicable law. We also reserve the right to ban users or accounts responsible for uploading such content. You are solely responsible for any content you upload and for ensuring that it does not infringe on any third-party rights or contain objectionable material.

You may not use generative artificial intelligence (AI) tools to create, produce, or generate any imagery, artwork, or other media that you upload to, or display on, the Site - including but not limited to profile pictures, avatars, banners, and other profile imagery, event names and imagery, and any other media associated with your account or with community events. ShinyDex reserves the right, at its sole discretion, to remove any imagery, events, or other content that we believe to have been created or generated using generative AI, and to take action against the accounts responsible, without notice, refund, or compensation.

Event Content Moderation

ShinyDex hosts a public event calendar that allows users to create and manage community events. To maintain a safe and welcoming environment for all users, ShinyDex reserves the right to review, edit, or remove any event content at our sole discretion, including but not limited to:

• Event names, titles, or display identifiers.
• Event descriptions, summaries, or promotional text.
• Event rules, requirements, or participation guidelines.
• Any images, links, or media associated with an event.

Content may be moderated if it is deemed offensive, misleading, harmful, in violation of these Terms, or otherwise inappropriate for the ShinyDex community. Event creators will not be entitled to compensation or refunds as a result of moderation actions. Repeated violations may result in loss of event creation privileges or account termination.

Prohibited Activities

You agree not to engage in the following prohibited activities:

• Violating any laws or regulations.
• Attempting to interfere with the operation of ShinyDex.com or other users' experiences.
• Using the Site to distribute spam or harmful content.
• Reverse engineering or attempting to extract source code or proprietary algorithms.

Intellectual Property

The Site and all of its original content are the sole property of The ShinyDex Team and are, as such, fully protected by the appropriate international copyright and other intellectual property rights laws. Original content includes, but is not limited to: Site design and Site logo.

The imagery and portrayal of Pokémon, pokéballs, terminology, and all other intellectual property related to and, or, referring to Pokémon or Pokémon related subjects used on the site are property of the Pokémon Company. Pokémon and all respective names and imagery are Trademark & © of Nintendo / Creatures Inc. / GAME FREAK Inc. 1996–2026.

You are not permitted to use, modify, or distribute this content without express permission from ShinyDex.com.

Limitation of Liability

To the fullest extent permitted by law, ShinyDex.com and its affiliates, partners, and employees shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from:

• Use or inability to use ShinyDex.com.
• Unauthorized access to your account or personal data.
• Errors, bugs, or inaccuracies in the Site content.

Modifications to Services and Terms

ShinyDex.com reserves the right to modify, suspend, or discontinue any part of the Site at any time, without prior notice. We may also update these Terms and Conditions periodically. Your continued use of the Site signifies your acceptance of any updates.

Termination

We reserve the right to suspend or terminate your account at our sole discretion if you violate these Terms and Conditions or engage in prohibited activities. In such cases, your access to ShinyDex.com may be permanently restricted.

Governing Law

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of Great Britain. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts in Great Britain.
